We are not required by law to appoint a data protection officer, and none has been appointed.
2. Hosting and server logs
Our shop and our email server run on our own servers at Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in data centers located in Germany. We have concluded a data processing agreement with Hetzner pursuant to Art. 28 GDPR.
When you access our pages, the web server automatically stores access data (IP address, date and time, requested address, amount of data transferred, browser identifier, referring page). This serves the secure and stable operation of the shop and the defense against attacks (Art. 6(1)(f) GDPR). The logs are deleted automatically after 14 days.
For simple visitor statistics, we also count how often the home page is accessed, how many visitors move from one shop page to the next, how often individual item and model pages are viewed and which terms are entered in the search. For this purpose we evaluate the browser identifier and the referring page; the IP address is used only briefly in memory and in anonymized form to avoid counting the same visitor more than once on the same day. Only daily totals and search terms without any personal reference are stored. No cookies are set and no data is stored on your device for this purpose (Art. 6(1)(f) GDPR).
3. Cookies
We only use technically necessary cookies (Section 25 (2) no. 2 of the German Telecommunications Digital Services Data Protection Act, TDDDG; Art. 6(1)(b) and (f) GDPR):
- warenkorb – assigns your cart to you (30 days),
- sitzung – keeps you signed in to your customer account after you sign in (14 days or until you sign out),
- design – stores the display style you have chosen, “Classic” or “Modern” (1 year; only set if you switch the display style or enter the shop via the link on our company website motocumlaude.de).
We do not use any analytics, advertising or tracking services and do not embed any third-party content (e.g. fonts or maps).
4. Orders and customer account
To process your order, we process the data you provide (name, address, email address, optionally company, phone number and VAT identification number, ordered items, payment and shipping data). The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(c) GDPR (statutory retention obligations).
If you create a customer account, we additionally store your password (only as an encrypted hash value) and your addresses until you delete the account. You can download your stored data and delete the account at any time in your customer account. When you register, we send you an email to confirm your address (double opt-in).
For business customers from other EU member states, we verify the VAT identification number provided using the European Commission’s VIES system (Art. 6(1)(c) GDPR).
5. Transfer of customer accounts from the previous shop “Dreher Oldtimerteile”
We continue the online shop “Dreher Oldtimerteile” at www.dreher-oldtimerteile.de. In doing so, we have taken over the customer accounts of the previous shop: salutation, name, email address, company, phone number, VAT identification number and the stored billing and delivery addresses. We have not taken over passwords or payment data. The source of this data is the previous shop operation “Dreher Oldtimerteile”.
The legal basis is our legitimate interest in continuing the shop and enabling former customers to keep using their customer account (Art. 6(1)(f) GDPR). We inform the data subjects once by email about the transfer; we do not send advertising without your consent.
You may object to the transfer at any time – an informal message to info@motocumlaude.de is sufficient, and we will then delete your account. Transferred accounts for which no password has been set within twelve months of the transfer will be deleted.
6. Payment service provider PayPal
If you pay with PayPal, you will be redirected to PayPal. In doing so, we transmit the order number and amount to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. PayPal is itself responsible for the processing of your data there; PayPal’s privacy statement applies. The legal basis is Art. 6(1)(b) GDPR.
7. Invoicing
We create invoices and credit notes with the accounting software Lexware Office of Haufe Service Center GmbH, Munzinger Straße 9, 79111 Freiburg, Germany. For this purpose, the billing address, ordered items and amounts are transmitted, and for tax-exempt deliveries also the email address and VAT identification number. We have concluded a data processing agreement with the provider pursuant to Art. 28 GDPR. The legal basis is Art. 6(1)(b) and (c) GDPR.
8. Shipping
For delivery, we pass on your name and delivery address to the shipping company we use (e.g. DHL, DPD, GLS, Hermes, UPS or Deutsche Post) (Art. 6(1)(b) GDPR). For deliveries to countries outside the European Union, these details are necessarily also received by the delivery and customs authorities in the destination country; the transfer is necessary for the performance of the purchase contract (Art. 49(1)(b) GDPR).
9. Inquiries, contact and withdrawal
If you send an inquiry about an item, write to us by email or use the withdrawal function, we process your details (name, email address, item, quantity, message) to handle your request (Art. 6(1)(b) GDPR). We confirm a withdrawal declared via the withdrawal function to you by email without delay; we reply to inquiries and messages at the email address you provided.
Back-in-stock notification. If you ask on an item page to be notified as soon as a part is back in stock, we store your email address, the item and the language. If you are not signed in to a customer account, we first send an email with a confirmation link; the notification only becomes active after you confirm it (double opt-in). The legal basis is your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time via the unsubscribe link or by writing to info@motocumlaude.de. We send exactly one message as soon as the item is in stock and delete the data 30 days later; unconfirmed requests after 48 hours, all others after 12 months at the latest.
10. “MotoCumLaude” app for iPhone and Android
Our app is available from the App Store of Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, and from Google Play of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The respective store operator is responsible for the data generated when downloading the app (e.g. your store account, time of download); we only receive aggregated, non-personal statistics from them.
The app displays our online shop. Sections 2 to 9 of this privacy policy therefore apply to page views, cart, customer account, orders and inquiries. The app identifies itself to our server with the identifier “MCLApp” so that we can display the pages appropriately for the app.
Saved items. Items you save in the app are stored only on your device. To display current prices and availability, the app queries the saved item numbers from our server without any reference to your person; apart from the server logs under section 2 (14 days), this query is not stored. The saved items are removed when you delete the app. Storage on your device is necessary for this function you have requested (Section 25 (2) no. 2 TDDDG).
Push notifications. We only send notifications if you allow them on your device and trigger the function yourself: “Notify me when in stock” for an item or “Notify me when it ships” after an order. The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25 (1) TDDDG), which you can withdraw at any time – in your phone’s settings, by tapping the button again or by deleting the app.
For delivery, Apple (Apple Push Notification service) or Google (Firebase Cloud Messaging of Google Ireland Limited) assigns a device-specific push token. For this purpose, we store: the push token, the operating system (iOS or Android), the language, the time of registration and of last use, the items about which you wish to be notified, for “Notify me when it ships” the link to the order and – only if you are signed in to your customer account in the app – the link to your customer account; in that case you will also receive shipping notifications for further orders from this account. We transmit the content of the notification (e.g. item name, order number and tracking number) to Apple or Google, which deliver it to your device. This may involve a transfer to the USA; Apple Inc. and Google LLC are certified under the EU-U.S. Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR). We have concluded a data processing agreement with Google for Firebase pursuant to Art. 28 GDPR.
We delete the data relating to a device 30 days after Apple or Google reports the push token to us as no longer valid (e.g. because the app has been deleted), but no later than 13 months after the last use of the app. Completed “when in stock” requests are deleted after one year, links to orders 30 days after the order.
No advertising, no tracking. The app does not contain any analytics, advertising or tracking services, does not read any advertising ID and does not use your location, camera, contacts or photos. When you share an item, the app opens your phone’s share menu; we do not learn with whom you share it.
11. Storage period
We delete your data as soon as it is no longer required for the stated purposes. We retain order and invoice data for up to 10 years due to obligations under commercial and tax law (Section 147 of the German Fiscal Code, AO; Section 257 HGB). Unconfirmed registrations and inquiries are deleted as soon as they have been dealt with or have become irrelevant. The retention periods for data from the app are set out in section 10.
12. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20), as well as the right to object to processing based on Art. 6(1)(f) GDPR on grounds relating to your particular situation (Art. 21). To exercise these rights, please contact info@motocumlaude.de.
Right to object: Where we process data on the basis of our legitimate interest (Art. 6(1)(f) GDPR – e.g. server logs, visitor statistics, transferred customer accounts), you may object to this processing at any time on grounds relating to your particular situation (Art. 21 GDPR). An informal message to info@motocumlaude.de is sufficient. You can withdraw any consent you have given (e.g. for push notifications) at any time with effect for the future (Art. 7(3) GDPR).
No automated decision-making, including profiling (Art. 22 GDPR), takes place.
You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany.
13. Obligation to provide data
We need the data marked as mandatory during checkout to conclude the contract. Without it, we cannot process the order.

25, 91710 Gunzenhausen, in Rechenzentren in Deutschland betrieben.
Keine Werbung, kein Tracking.
